MariaDB商标和版权

10月20日，Monty专门撰文解释了MariaDB商标相关的协议，也解释了背后这么做的原因和历史。本文也顺便介绍了一下MariaDB的代码分发协议。

MariaDB商标讨论很早之前邮件组就有，例如：Jeremy Cole的邮件The MariaDB Foundation and MariaDB trademark?，Federico Razzoli的邮件trademarks，Mark Callaghan也关注过这个问题：Google search for “mariadb trademark”。因为一些原因，MariaDB商标归属一直都没有明确对外说明，这次算是敲定了。

MariaDB Corporation和MariaDB Foundation

先解释两个组织或公司：MariaDB Corporation和MariaDB Foundation。

MariaDB Corporation Ab(有时也叫MariaDB Corporation): 是一家商业公司(stock company)，前身是SkySQL，是一家支持MariaDB，MySQL培训、咨询的商业公司，提供MariaDB Enterprise和MariaDB Enterprise Cluster等服务。

MariaDB Foundation: 致力于推广、保护、改进MariaDB的代码、社区、和相关生态系统。是一个非盈利组织，在特拉华州(delaware)注册。

虽说是两个独立的组织，其核心都是MariaDB。现在MariaDB Foundation的临时董事(Directors)是如下四人：Rasmus Johansson (chair)，Michael “Monty” Widenius，Jeremy Zawodny，Sergei Golubchik，除了Jeremy Zawodny是就职于Craigslist.com，其他人都就职于MariaDB Corporation Ab。

概述MariaDB商标协议

“MariaDB”商标完全归MariaDB Corporation所有。MariaDB Foundation拥有其独家商标授权，授权的商标包括：”MariaDB Server”、”MariaDB Foundation”、”MariaDB.org”以及对应的Logo。(参考：Exhibit A)

另外，很有意思，在MariaDB Corp的Knowledge Base中还有如下的Public Promise(3年前)：

大意是：MariaDB Corp要担负起维护MariaDB的责任。如果这点没做到，那么商标管理将自动移交给像MariaDB Foundation这样的非盈利组织。如果，MariaDB Corp被收购，这点也同样适用于对应的收购者。

原文：

This policy requires MariaDB to maintain its role as active and primary developer of MariaDB. If 
MariaDB should fail to do so, the trademark management will automatically be assigned to a 
non-profit organization like the MariaDB Foundation. The same promise will trigger should 
MariaDB be bought and the buyer fail to maintain its role as active and primary developer 
of MariaDB.

这段文字不知道是否具有法律效应，因为这段文字中，很多内容都很模糊。

为什么商标归属很重要

这关系到”MariaDB”这个品牌是否可以持续的发展下去。一方面，这份协议确定了MariaDB Corp对商标的拥有权，可以依据此进行对应的商业活动，确保公司业务的顺利开展，也确保随着MariaDB的日益流行，公司能够从中收益(“仰仗”此商标对外提供服务)。更重要的是，这份协议也在法律意义上，确定了MariaDB Foundation可以自由的使用MariaDB Server等商标和logo，让社区能够自由发展。各取所需。

这里可以看到商业和开源的一种平衡。

MariaDB遵循什么协议分发

这和商标问题没有关系。MariaDB Server遵循GPL协议分发。参考

MariaDB代码归谁所有

那每一个Contributor提交的代码呢？和很多开源软件一样，在向MariaDB提交代码的之前，会被要求签署一份MariaDB Contributor Agreement(MCA)，这份协议会指定MariaDB Foundation为joint ownership，并拥有几乎所有代码的处置权。原文：

you agree that each of us can do all things in relation to your contribution as if each of us were 
the sole owners, and if one of us makes a derivative work of your contribution, the one who makes the 
derivative work (or has it made) will be the sole owner of that derivative work;

当然，你也可以不签署MCA，直接使用BSD协议提交你的代码。
